TERMS & CONDITIONSIt is the clients responsibility to read and fully understand these terms and conditions prior to commencement of any works. These terms and conditions shall come into force on our acceptance of your order and shall apply to all orders received whether in writing or otherwise. These terms and conditions shall prevail in all areas except where specifically referenced as excluded by us in writing. We reserve the right to refuse any order at any time. No variation to the order will be accepted/sanctioned unless agreed by us in writing (confirmation email, estimate etc). We reserve the right to cancel your order if you or your company commit an act of bankruptcy, commence a winding up order under the Insolvency Act or are found to be committing a criminal offence. We reserve the right to cancel your order if we believe it to have a detrimental affect to Urban Sparks Electrical Limited either financially or otherwise. Installation and related work. All electrical installations and related work will comply with the latest version of BS7671 and any amendments in force at the time of works. (currently BS 7671:2018+A3:2024) All electrical installations and related work will comply with the applicable Building Regulations in force at the time of works. Where work is to extend or modify existing circuits, the estimated costs assume the installation is in adequate condition and complies with the minimum current standards and regulations. Any works found to require alteration of the necessary parts of the existing installation up to current standards will be an additional cost. Unless stated otherwise, all cables will be concealed by chasing into the building fabric or concealed in building voids, under floors etc. Where this is not possible, cables will be neatly surface mounted , either clipped directly or housed in trunking/conduit. Where floorboards, carpet or other flooring may require lifting to allow concealed installation or investigation work, there is no additional charge for this service and we shall endeavour to avoid damage and refit to an acceptable standard. However, you may wish to consider employing a specialist fitter to ensure a fully satisfactory re-fitment at your own expense. Where agreed before hand, at an extra charge, chases to walls etc will be refilled to a 2mm (+-2mm tolerance) below plaster finish depth allowing for a final skim coat and decoration which is excluded. All endeavours will be made to carry out works to a clean standard using dust sheets and vacuum cleaning as necessary. It should be noted that dust is inevitable. If further cleaning is required, you the client will be responsible. Estimates are for white plastic standard accessories. Choice of brand is at the discretion of Urban Sparks Electrical Limited. This includes, but is not limited to, sockets, outlets, fused spur connections, data and AV outlets, switches, isolators, trunking/conduit, ceiling pendants, uplighters, down lights, wall mounted lighting, security lighting and fittings, unless otherwise specified by the client and the fees will be adjusted to reflect this. If the client is providing goods/materials a full specification must be provided before an estimate can be given. The estimate/contract shall outline the expected duration of works if not already verbally expressed upon initial site survey. Whilst undertaking any works at the property, the client is required to provide clean and safe drinking water, power and access to hygiene facilities free of charge. Exclusions. Cleaning and/or moving furniture and other items is not included. You the client are required to ensure any valuable items (antiques, artwork, irreplaceable items, items of substantial value, pets etc) are moved or protected appropriately. Except where detailed, builders work (the creating of holes larger than 50mm to building structures, the creating of support structures, digging of trenches and/or holes to surrounding grounds etc) are not included except as detailed above. Redecoration and final making good is excluded from estimated costs unless specifically detailed as included. Removal from site and disposal of rubble, fittings, wiring, materials, general waste and packaging is not included. Parking fees (with proof where possible) are an additional cost. Extras and Variations. All extras and variations must be agreed in writing or verbally (depending on the nature of the work) and deposit taken where necessary prior to the work commencing. Pricing. The estimated costs assume continuous and unhindered access to the site by prior arrangement with you. If restrictions are applied, 48hours minimum notice is required, otherwise charges will be incurred. The customer continues to grant and facilitate the necessary access to the premises if the original duration as stipulated in the contracted works is to remain valid. Unless stated otherwise, the working hours of 09:00 – 16:00, Monday to Friday inclusive (excluding National Public Holidays). Access may be required outside these hours, therefore, 24hour access may be required (including Saturday, Sunday and National Public Holidays) for residential call outs. Any additional work outside our estimated figures will incur additional time charges at the current rate (please enquire for up-to-date pricing) per hour plus materials. Except where the additional work is estimated as a separate job. Travel costs will also be changed as necessary. All final estimated figures include VAT. Urban Sparks Electrical Limited is currently VAT registered. VAT Number: 430001769 All estimated figures are valid for 30 calendar days from the date of the estimate. You have a cooling off period of 7 calendar days from accepting an estimate or the length of time to the commencement of works if less than 7 calendar days. Over 7 calendar days will incur a cancellation fee. Deviations from Building Regulations and BS7671. All work where applicable will be executed in full compliance of the applicable Building Regulations and BS7671 in force at the time of works, especially in respect of work in dwellings to allow the legal Part P obligations to be met. Where a deviation from such regulations are necessary, a written instruction, record and risk assessment by authorised personnel will be required. This may require a third-party assessment incurring additional costs. Risk and Title of Goods and Property. All risks on all goods supplied will pass onto the client upon delivery. All goods supplied shall remain the property of Urban Sparks Electrical Limited until all sums are paid in full and can be removed at any given point without notice. The client is responsible for ensuring the property is adequately insured for the duration of the prescribed installation works. Customer Requirements. Commencement of work: Every effort will be made to meet the requirements of the customer, but no binding guarantee can be given of the date of commencement or completion. Urban Sparks Electrical Limited accepts no responsibility for any delay in the execution of work or inconvenience caused due to non-delivery or shortage of materials or causes beyond the control of Urban Sparks Electrical Limited. Testing: All installation work will be tested during and upon completion for insulation resistance, earthing, continuity and fault protection. All tests are in compliance with current legislation and regulations. Any other tests required will be charged as extra if not specified in the estimate/contract. Wayleaves: You, the client, will be responsible for all necessary consents, easements or wayleaves and for the reinstatement/rectification of disturbed ground which are within the boundary of the clients own property, privately owned or that where the clients has rights, access or tenancy. Licenses: Any license, permit or other authoritive requirement necessary for the work to be executed is the responsibility of the client. Photographs and Video Recordings. Urban Sparks Electrical Limited reserves the right to take photographs and video recordings of any works and/or related working areas. This will be for our records and evidential use. This is non-negotiable. Photographs and video recordings for our portfolio including social media and advertising will be in line with our privacy policy unless a written request prior to commencement not to use them is given. Photographs and video may include the surrounding area. Please provide any restrictions in writing. Where works are carried out in establishments primarily for vulnerable people (schools, children’s centres etc) care will be taken not to include any person in photographs or videos due to safeguarding policies. Payment and Charges. Unless otherwise agreed in writing, you, the client, are required to make payment in full upon completion of the works. A deposit will be required prior to commencement of works. This is non-refundable and values vary. Stage payments are required when the planned work exceeds 14 calendar days, or the cost is in excess of £1000.00 (GBP). Interest will be charged for each calendar day at a rate of 8.75% for late payments. In the event of failure to pay, your debt can be handed over to third parties (debt recovery) at your expense. Disputes. In the event of a dispute, mediation is the preferred method to reach a resolution. Payment for the full amount is expected regardless of any dispute, unresolved or otherwise. Any dispute with a subcontractor used by us should be taken up with them directly. In the unlikely event of a complaint, any remedial work will be carried out by Urban Sparks Electrical Limited or chosen subcontractor by us for the relevant trade. We do not pay for others to undertake such tasks. Warranty. Urban Sparks Electrical Limited provides a 6-month defect warranty on all works from invoice date. All materials and products are covered by manufacturers warranties. Any defect arising from faulty installation or repair work within the 6-month warranty period will be rectified at no extra cost to you. This warranty does not extend to goods not supplied by Urban Sparks Electrical Limited, physical damage to products, previous installations or works not carried out by Urban Sparks Electrical Limited or any instance where the original installation or works has been altered or tampered with by third parties. PRIVACY POLICYPrivacy Policy: This Privacy Policy has been compiled by Urban Sparks Electrical Limited. to comply with the General Data Protection Regulations [GDPR] 2018. The purpose of this policy is to inform the individual the means of collection of their personal data, including the security of that data; the means of processing that data; how long it is kept for; our obligations; and the rights of the Data Subject [the individual] under the GDPR. There is one nominated individual within our company/firm individual responsible for data under the GDPR. The roles undertaken are twofold, namely; The Data Controller and the Data Processor. A Controller determines the purposes and means of processing personal data and a Processor is responsible for processing personal data on behalf of a controller. The six bases are as follows: Consent: Consent must be freely given, specific, informed and unambiguous. There must be a positive opt-in – consent cannot be inferred from silence, pre-ticked boxes or inactivity. It must also be separate from other terms and conditions, and simple ways for the withdrawal of consent will be required. Contract: Processing is necessary for a contract with an individual, or because that individual has asked that specific steps be taken before entering into a contract. Legal Obligation: Processing is necessary to comply with the law (not including contractual obligations). Vital Interests: Processing is necessary to protect an individual’s life. Public Task: Processing is necessary for the performance of a task in the public interest or for official functions, and the task or function has a clear basis in law. Legitimate Interests: Processing is necessary for our legitimate interests or the legitimate interests of a third party unless there is a good reason to protect the individual’s personal data which overrides those legitimate interests. In order to rely on a ‘legitimate interest’ basis we undertake a three-part test which must be satisfied: A legitimate interest has been identified; It can be shown that processing is necessary to achieve it; and Such processing has been balanced against the individual’s [data subject’s] interests, rights and freedoms. Furthermore under the GDPR the Data Subject [individual] has a number of rights [seven] regarding the collection and processing of their data. For the purposes of the GDPR Data is identified under two categories: Personal Data: Any ‘personal data’ relating to an identifiable person held automatically or manually. Sensitive Personal Data: Including genetic & biometric where processed to uniquely identify an individual. The seven rights of the Data Subject are: Right to be informed: The right to be informed encompasses the obligation to provide “fair processing information”. It emphasises the need for transparency in the use of personal data. Right of Access: Data Subjects have the right to access their personal data and supplementary information. The right of access allows individuals to be aware of and verify the lawfulness of the processing. Such a Data Access Request will be provided free of charge within one month, with the following exceptions/provisos: Such a request is manifestly unfounded or excessive; Such a request is repetitive; Such a request requires copies of previously provided information. In the event of charges being raised the firm will notify in advance such costs which in any event will be based on the administrative cost of providing the requested information. In the event of manifestly unfair or excessive requests we may refuse to respond to the request and any such refusal will be notified to the requester [data subject] with a reason for the refusal and, in addition, information as to the data subject’s rights to complain to the supervisory body or judicial authority within one month of such a request being received. Right to Rectification: The GDPR gives Data Subjects the right to have personal data rectified. Personal data can be rectified if it is inaccurate or incomplete. Right to Erasure: This right is to enable a Data Subject to request the deletion or removal of personal data where there is no compelling reason for its continued processing. Right to Restrict Processing: Individuals have a right to ‘block’ or suppress processing of personal data. When processing is restricted, storage of the personal data is permitted, but not to further process it. Information can be retained just enough for the individual to ensure that the restriction is respected in future. Right to Data Portability: The right to data portability allows individuals to obtain and reuse their personal data for their own purposes across different services. It allows them to move copy or transfer personal data easily from one IT environment to another in a safe and secure way, without hindrance to usability. Right to Object: The right to object to processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling); direct marketing (including profiling); and processing for purposes of scientific/historical research and statistics. As well as this notice to the Right to Object in this policy, we will, in all initial communications with a data subject, inform them of this right separately from any other information. The following identifies the types of data we collect, control and process; and the legal basis we rely upon for doing so: The Data Subject's name, address, telephone numbers, and e-mail addresses are used for managing the Data Subject's relationship with the Firm and performing the Firm's contract with the Data Subject. The Data Subject’s name and email address are used for mail shots and marketing purposes based on legitimate interest. The Data Subject may object at any time and will be informed accordingly. Bank account details or payment details are used to pay, be paid, or to refund monies, in order to fulfil the contract between the Firm and the Data Subject. How long will personal data be used for? We will only retain personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and the Data subject’s data, the purposes for which we process the data and whether we can achieve those purposes through other means, and the applicable legal requirements. Nevertheless by law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for at least six years after they cease being customers for tax purposes. In some circumstances we may anonymise the Data Subject’s data (so that it can no longer be associated with them) for research or statistical purposes in which case we may use this information indefinitely without further notice to the Data subject. The Firm uses the following software to store and process personal data: Tradify Job Management Software NICEIC Certification Software Google Drive Microsoft Windows Quickbooks Mailer Lite The Firm will protect the data we collect in the following ways: The Data Subject’s data will not be transferred outside the European Economic Area [EEA], or a country recognised by the EU as an 'adequate' country (i.e. safe country) without the explicit consent of the Data Subject; The Firm has in place general recognised standards of technology including operational security including, but not limited to, data encryption thereby enabling the protection of relevant data from misuse, loss, damage, alteration, destruction or unauthorised access. Any receipt or transfer of funds will be via recognised secure payment systems. The firm will securely destroy any financial information once used and no longer needed other than required by law. The firm’s website will adhere to SSL encryption protocols. Any breach of data which may pose a serious risk will be notified to the Data Subject without delay. The Firm will not sell, pass on or contract with third parties Data Subject’s data without prior written [withdrawable] consent other than where required to by law; or otherwise detailed; or as follows: A Data Subject’s data may be passed to third parties which are under contract with the Firm to provide services to the Data Subject on the firm’s behalf. In such an event the data shared is only that necessary to fulfil the service requirement under the terms of the contract with the Firm. Within such a contract an express condition will be that the third party keep any data secure and not to use in any other way, such data, for their own or other parties purposes. The Firm will retain the Data Subject information for as long as necessary under the legal bases as identified in the “How long will personal data be used for?” section above or to comply with any legal obligation on the Firm’s part. The firm will review annually the data it holds to establish whether it continues to have the right to process it. Should such a right fail to continue to apply the Firm will cease from processing such data. Data may be retained thereafter in order to comply with any legal obligations which may arise. Cookie Policy: A cookie is a text file placed on your hard disk by a Web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you the user. A primary purpose of a cookie is to inform a web server that user has returned to a specific page on a web site. For example if a user personalises our Web page or registers with our website or services a cookie will enable us to recall specific personal data such as billing and delivery addresses. On a user’s return to our site the data previously provided can be retrieved thereby facilitating our services and features previously customised. The control and processing of any such data will be undertaken in line with the General Data Protection Regulation [GDPR] 2018. Cookies can be accepted or declined. Web browsers have tools to modify cookie settings and can be set to decline if preferred by the user. Should the use of cookies be declined when using our web site there may be a loss of functionality and loss of potential services.
